Welcome to AssetCurrent, a digital asset management system developed and operated by Definitive Ware LLC ("we", "us", "our"). By using AssetCurrent you ("user", "you", "your") agree to abide by the following Terms of Service. Please read this agreement carefully before using our services.
1. Acceptance of Terms
By accessing or using AssetCurrent, you agree to comply with and be legally bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
2. Service Description
AssetCurrent provides a secure platform for storing, organizing, and managing digital assets. Users can add digital assets to their accounts in three ways: uploading a file, attaching an external link, or entering text. Our service is offered through various subscription plans, including Standard and Premium tiers, with monthly or yearly billing options.
3. Payments and Subscriptions
- Payments for using AssetCurrent are made on a monthly or yearly basis, depending on the selected plan.
- The default payment method will be automatically charged for the renewal of your subscription.
- All payments are processed securely through Stripe. We do not process or store payment information.
- If payment collection fails, your service will be suspended, and your plan will be marked as expired.
- Users with an expired plan can still view and manually delete their stored data.
- We reserve the right to permanently delete all account data 180 days after plan expiration.
- Information deleted by users, or removed by us 180 days after plan expiration, cannot be recovered.
4. Plan Modifications and Cancellations
- Users may switch between plans or change their billing cycle (monthly/yearly).
- If only the billing cycle is changed, the new plan will take effect after the current term ends. Users can cancel this transition before the new plan starts.
- If upgrading to a higher plan, changes will take effect immediately, and the user will be charged a prorated amount.
- Users may cancel their subscription at any time. The plan will remain active until the end of the current term, after which it will be marked as expired, and no further charges will be applied.
5. Data Storage and Usage Limits
- Each subscription plan has a defined storage limit for file uploads and text inputs.
- Users can monitor their current usage on the User Settings page.
- Users exceeding their storage limits may need to upgrade their plan to continue uploading files.
- We can adjust storage limits for each plan from time to time without reducing the space you have already used, in accordance with the previous limits.
6. Data Security and Liability
- We take security seriously and implement industry best-practice security measures to protect your data.
- However, we cannot guarantee absolute security and are not liable for any data breaches, unauthorized access, or service failures.
- Users are responsible for maintaining backups of their important data.
7. Termination and Account Deletion
Definitive Ware LLC reserves the right to terminate accounts in cases of:
- Violation of these terms or illegal activities.
- Non-payment beyond 180 day after plan expiration.
- Legal obligations requiring termination.
However, we prioritize user privacy and will challenge any government requests to access or delete data to ensure they are lawful and do not violate human rights. We will only comply when legally obligated and after exhausting all reasonable legal defenses.
8. Modifications to Terms
We may update these Terms of Service from time to time. Users will be notified of significant changes, and continued use of AssetCurrent constitutes acceptance of the revised terms.
